Tachara LLC یک شرکت تگزاسی است و Tolu طبق قانون ایمنی دوستیابی اینترنتی تگزاس (فصل ۱۰۶ قانون تجارت و بازرگانی تگزاس) یک سرویس دوستیابی آنلاین محسوب می‌شود. افشاگری‌های زیر برای همه کاربران، از جمله کاربران ساکن تگزاس، ارائه می‌شود.

هشدار مهم درباره بررسی سوابق

توجه: Tachara LLC بررسی سوابق کیفری اعضای خود را انجام نمی‌دهد. ما اعضا را در پایگاه‌های داده مجرمین جنسی یا هیچ پایگاه سوابق کیفری بررسی نمی‌کنیم. فردی که در Tolu ملاقات می‌کنید ممکن است سابقه کیفری داشته باشد.

اطلاعیه آگاهی از ایمنی

• نام خانوادگی، نشانی منزل، محل کار یا برنامه روزانه خود را در پروفایل یا در پیام‌های اولیه ننویسید
• به هیچ‌کس که در Tolu ملاقات می‌کنید پول، گیفت کارت، ارز دیجیتال یا اطلاعات حساب مالی نفرستید، هر داستانی که برایتان تعریف کند
• به کسی که خیلی زود ابراز عشق می‌کند، از تماس تصویری طفره می‌رود، ادعا می‌کند در سفر یا شاغل در خارج از کشور است، یا فوراً می‌خواهد گفتگو را از Tolu بیرون ببرد، مشکوک باشید
• پیش از ملاقات حضوری تماس تصویری بگیرید و عکس‌ها و مشخصات آن فرد را آنلاین جستجو کنید
• چند قرار اول را در مکان عمومی بگذارید و رفت و برگشت خود را خودتان ترتیب دهید
• به یک دوست یا عضو خانواده بگویید کجا می‌روید، با چه کسی قرار دارید و کی برمی‌گردید. موقعیت زنده خود را با او به اشتراک بگذارید
• هوشیار بمانید و کنترل نوشیدنی و گوشی خود را از دست ندهید
• اگر چیزی درست به نظر نمی‌رسد، آنجا را ترک کنید. شما به کسی توضیح بدهکار نیستید
• هر کسی را که به شما فشار می‌آورد، تهدید می‌کند یا آزار می‌دهد مسدود و گزارش کنید، و اگر در خطر هستید با پلیس محل تماس بگیرید. در شرایط اضطراری در ایالات متحده با ۹۱۱ تماس بگیرید

آگاهی از کلاهبرداری و سرقت هویت

هرگز رمز عبور، کدهای ورود یک‌بارمصرف، مدارک هویتی، اطلاعات بانکی یا تصاویر خصوصی خود را با کسی که آنلاین ملاقات کرده‌اید به اشتراک نگذارید. کارکنان Tolu هیچ‌گاه از شما رمز عبور نمی‌خواهند و هیچ‌گاه خارج از Apple App Store یا Google Play از شما درخواست پرداخت نمی‌کنند.

✅ پذیرش شرایط

این شرایط قراردادی بین شما و Tachara LLC است که شرایط قانونی الزام‌آور استفاده از سرویس را تعیین می‌کند. این توافقنامه شامل سیاست حفظ حریم خصوصی، سیاست ایمنی کودکان و هر شرایط دیگری است که هنگام خرید یا استفاده از امکانات، محصولات یا خدمات اضافی به شما اعلام و توسط شما پذیرفته می‌شود.

با دسترسی یا استفاده از سرویس، شما این توافقنامه را می‌پذیرید، با شرایط، ضوابط و اطلاعیه‌های مندرج یا ارجاع‌شده در آن موافقت می‌کنید و رضایت می‌دهید که این توافقنامه و همه اطلاعیه‌ها به شکل الکترونیکی به شما ارائه شود.

سیاست حفظ حریم خصوصی، نحوه استفاده از اطلاعات حساب، دستگاه، موقعیت تقریبی و محتوای شما را توضیح می‌دهد. پذیرش این شرایط جایگزین رضایت جداگانه‌ای که قانون الزام می‌کند نیست.

🔄 تغییرات این شرایط

ما ممکن است این شرایط را تغییر دهیم. اگر تغییری مهم باشد، حداقل ۳۰ روز پیش از اجرایی‌شدن آن، از طریق ایمیل یا اطلاعیه داخل برنامه به شما اطلاع می‌دهیم و تاریخ «آخرین به‌روزرسانی» را تغییر می‌دهیم. تغییرات غیرمهم از زمان انتشار اجرایی می‌شوند.

ادامه استفاده شما از سرویس پس از اجرایی‌شدن تغییر، به معنای پذیرش شرایط اصلاح‌شده است. اگر آن‌ها را نمی‌پذیرید، پیش از تاریخ اجرا حساب خود را حذف کنید. تغییرات بخش حل اختلاف فقط بر دعاوی‌ای اعمال می‌شود که پس از تاریخ اجرای تغییر ایجاد شوند.

🔞 شرایط احراز صلاحیت

برای استفاده از Tolu باید حداقل ۱۸ سال سن داشته باشید. هیچ بخشی از سرویس برای افراد زیر ۱۸ سال در نظر گرفته نشده و استفاده از سرویس در هر جایی که ممنوع باشد باطل است.

با دسترسی و استفاده از سرویس، شما اعلام و تضمین می‌کنید که:

• هجده (۱۸) سال یا بیشتر سن دارید و از نظر قانونی توانایی انعقاد این توافقنامه را دارید
• تاریخ تولد و سایر اطلاعات ثبت‌نام شما درست و دقیق است
• هرگز محکوم به جنایت، جرم جنسی یا هر جرم شامل خشونت نشده‌اید و در چنین اتهامی اقرار به عدم دفاع نکرده‌اید
• ملزم به ثبت‌نام به‌عنوان مجرم جنسی در هیچ رجیستری دولتی نیستید
• بیش از یک حساب کاربری در سرویس ندارید
• قبلاً توسط ما از سرویس حذف نشده‌اید، مگر آنکه اجازه کتبی صریح ما را برای ساخت حساب جدید داشته باشید
• در کشور یا منطقه‌ای مشمول تحریم‌های ایالات متحده که ارائه سرویس به شما را ممنوع کند ساکن نیستید و در فهرست اشخاص تحریم‌شده قرار ندارید

ما به اظهار شما درباره سن، به رده‌بندی سنی و سیگنال‌های سنی ارائه‌شده توسط Apple App Store و Google Play، و به بررسی‌های خودکار و دستی خودمان اتکا می‌کنیم. اعلام نادرست سن، نقض اساسی این توافقنامه است و به خاتمه فوری حساب منجر می‌شود.

👤 ثبت نام حساب کاربری

برای استفاده از سرویس باید با روشی که ما ارائه می‌دهیم ثبت‌نام کنید. شما به ما اجازه می‌دهید طبق سیاست حفظ حریم خصوصی به اطلاعات مشخصی از حساب دسترسی داشته باشیم و از آن استفاده کنیم.

شما اعلام و تضمین می‌کنید که تمام اطلاعاتی که در ارتباط با حسابتان ارائه می‌دهید فعلی، کامل و دقیق است و آن را به‌روز نگه می‌دارید. همچنین تضمین می‌کنید که هویت هیچ شخص یا نهادی را جعل نمی‌کنید و عکس‌های روی پروفایل شما واقعاً خود شما را نشان می‌دهند.

شما تأیید می‌کنید که ممکن است آدرس IP، شناسه دستگاه و الگوهای استفاده شما را ثبت و تحلیل کنیم و عکس‌ها، پیام‌ها، رسانه‌ها و سایر محتوای داخل برنامه را به‌صورت خودکار یا دستی، در حد معقول و لازم برای حفاظت از سرویس و کاربران، بررسی گزارش‌ها، جلوگیری از اسپم و کلاهبرداری و اجرای این شرایط، بازبینی کنیم. برای جزئیات تأمین‌کنندگان بازبینی محتوا، سیاست حفظ حریم خصوصی را ببینید.

👤 فقط استفاده شخصی

شما نمی‌توانید در هیچ زمانی از حساب شخص دیگری استفاده کنید. نمی‌توانید دسترسی به حساب یا نام کاربری خود را بخرید، بفروشید، اجاره دهید یا واگذار کنید و نباید اطلاعات ورود خود را در اختیار دیگری بگذارید.

حساب کاربری و سرویس فقط برای استفاده شخصی و غیرتجاری شماست و نمی‌توان آن را در فعالیت‌های تجاری به کار برد، مانند:

• تبلیغ یا درخواست از کاربران برای خرید یا فروش محصولات یا خدماتی که توسط شرکت ارائه نمی‌شود
• دعوت دیگران به مهمانی یا مراسم اجتماعی، یا شبکه‌سازی، با اهداف تجاری
• تبلیغ پلتفرم، سرویس، کسب‌وکار، کانال یا کمپین جمع‌آوری پول دیگر
• استخراج، خزش یا جمع‌آوری پروفایل‌ها، عکس‌ها یا محتوا، چه دستی و چه خودکار، از جمله برای آموزش هر مدل یادگیری ماشین یا هوش مصنوعی

🔐 امنیت حساب کاربری

شما مسئول حفظ محرمانگی اطلاعات ورود خود هستید و تنها مسئول تمام فعالیت‌هایی هستید که تحت حساب شما انجام می‌شود.

هرگونه افشا یا استفاده غیرمجاز از اطلاعات ورود خود یا هر نقض امنیتی دیگر را فوراً به info@tolu.dating اطلاع دهید.

💳 اشتراک پولی ماهانه

Tolu امکانات اختیاری پولی مانند Tolu Plus / Premium ارائه می‌کند. اشتراک پولی Tolu یک اشتراک ماهانه با تمدید خودکار است و می‌تواند شامل سوایپ نامحدود، پیام‌رسانی نامحدود، مشاهده کسانی که شما را لایک کرده‌اند، مشاهده بازدیدکنندگان پروفایل، فیلترکردن اینکه چه کسی به شما پیام بدهد و چه کسی پروفایل شما را ببیند، و پروموت‌شدن پروفایل باشد.

قیمت، صورتحساب و تمدید

• اشتراک از طریق Apple App Store یا Google Play خریداری و مدیریت می‌شود. Tolu پرداخت شما را پردازش نمی‌کند و هیچ‌گاه اطلاعات کامل کارت شما را دریافت نمی‌کند
• قیمت ماهانه و دوره صورتحساب پیش از تأیید خرید توسط همان فروشگاه نمایش داده می‌شود
• مبلغ در زمان تأیید خرید از حساب فروشگاهی شما کسر می‌شود
• اشتراک هر ماه به‌صورت خودکار با قیمت روز تمدید می‌شود مگر آنکه لغو کنید، و مبلغ تمدید ظرف ۲۴ ساعت پیش از پایان دوره جاری کسر می‌شود
• برای اینکه مبلغی کسر نشود، حداقل ۲۴ ساعت پیش از پایان دوره صورتحساب جاری لغو کنید

نحوه لغو

هر زمان می‌توانید از تنظیمات حساب Apple App Store یا Google Play خود، در بخش اشتراک‌ها، لغو کنید. لغو در پایان دوره صورتحساب جاری اعمال می‌شود و تا آن زمان امکانات پولی برای شما فعال می‌ماند.

حذف حساب Tolu، اشتراک فروشگاهی شما را لغو نمی‌کند. برای توقف شارژهای بعدی باید اشتراک را در همان فروشگاهی که از آن خرید کرده‌اید لغو کنید.

دوره آزمایشی رایگان

ما ممکن است یک دوره آزمایشی رایگان یک‌بار مصرف برای امکانات پولی ارائه کنیم. مگر آنکه پیش از پایان دوره آزمایشی لغو کنید، این دوره به اشتراک ماهانه پولی با قیمت روز تبدیل می‌شود. دوره آزمایشی رایگان فقط یک بار برای هر فرد قابل استفاده است و ما می‌توانیم هر زمان آن را تغییر دهیم یا حذف کنیم.

بازپرداخت

چون پرداخت توسط اپل و گوگل انجام می‌شود، بازپرداخت‌ها توسط آن‌ها و طبق سیاست‌های خودشان رسیدگی می‌شود و Tolu نمی‌تواند برای خرید فروشگاهی بازپرداخت صادر کند. درخواست بازپرداخت را از طریق اپل یا گوگل ثبت کنید. هیچ‌یک از موارد بالا حق غیرقابل‌سلب بازپرداخت یا لغو شما را طبق قانون ایالت یا کشور محل سکونتتان، از جمله حق لغو کالیفرنیا که در ادامه توضیح داده شده، محدود نمی‌کند.

امکانات پولی و اقلام مجازی

امکانات پولی، بوست و هر قلم مجازی دیگر، یک مجوز محدود، شخصی، غیرقابل‌انتقال و قابل‌ابطال برای استفاده از یک امکان سرویس هستند. آن‌ها دارایی نیستند، ارزش نقدی ندارند، قابل تبدیل به پول نیستند و قابل فروش، معامله یا انتقال نیستند. امکانات استفاده‌نشده پس از لغو منتقل نمی‌شوند و ما می‌توانیم یک امکان پولی را تغییر دهیم یا متوقف کنیم، با اطلاع قبلی در مواردی که تغییر مهم باشد.

⚠️ ایمنی - تعاملات شما با سایر کاربران

شما تنها مسئول تعاملات خود با سایر کاربران هستید. شما درک می‌کنید که ما بررسی سوابق کیفری یا احراز هویت کاربران را انجام نمی‌دهیم. شرکت هیچ اظهارنظر یا تضمینی درباره رفتار کاربران، درستی آنچه درباره خودشان می‌گویند، یا سازگاری آن‌ها با کاربران فعلی یا آینده ارائه نمی‌دهد.

شرکت مسئول رفتار هیچ کاربری، چه آنلاین و چه آفلاین، نیست. شما تمام مسئولیت ارتباطات و تعاملات آغازشده از طریق سرویس و هر تصمیم به ملاقات حضوری با کاربر دیگر را بر عهده می‌گیرید.

ما در برنامه ابزارهایی برای مسدودکردن و گزارش کاربرانی که این شرایط را نقض می‌کنند یا رفتار توهین‌آمیز دارند فراهم کرده‌ایم. گزارش‌ها را بررسی می‌کنیم و اقدام لازم، از جمله حذف محتوا و تعلیق حساب، معمولاً ظرف ۲۴ ساعت انجام می‌شود.

©️ مالکیت فکری

شرکت مالک تمام حقوق مالکیتی در سرویس و در تمام محتوا، علائم تجاری، نام‌های تجاری، علائم خدماتی و سایر حقوق مالکیت فکری مرتبط با آن است و آن‌ها را حفظ می‌کند.

با رعایت این شرایط، ما به شما یک مجوز محدود، شخصی، غیرانحصاری، غیرقابل‌انتقال و قابل‌ابطال برای دسترسی و استفاده از سرویس برای مصرف شخصی و غیرتجاری خودتان اعطا می‌کنیم.

شما موافقت می‌کنید بدون رضایت کتبی قبلی ما، هیچ مطلب دارای حق نشر، علامت تجاری، نام تجاری، علامت خدماتی یا سایر اطلاعات مالکیتی قابل دسترس از طریق سرویس را کپی، تغییر، منتقل، یا از آن اثر مشتق تولید یا بازتولید نکنید.

📝 محتوای شما و مجوزی که به ما می‌دهید

شما تنها مسئول محتوا و اطلاعاتی هستید که در سرویس ارسال، بارگذاری، منتشر، لینک، منتقل، ضبط یا نمایش می‌دهید یا برای سایر کاربران می‌فرستید، از جمله پیام‌ها، چت، ویدیو، عکس، فایل صوتی و متن پروفایل («محتوا»).

مالکیت محتوای شما نزد خودتان می‌ماند. شما هیچ مالکیتی به ما منتقل نمی‌کنید.

مجوز

با انتشار محتوا در سرویس، شما به شرکت یک مجوز غیرانحصاری، جهانی، بدون حق امتیاز و قابل واگذاری (فقط به ارائه‌دهندگان خدمات ما مانند هاستینگ، تحویل رسانه و بازبینی محتوا) اعطا می‌کنید تا آن محتوا را میزبانی، ذخیره، کش، کپی، بازتولید، نمایش، تطبیق، بازقالب‌بندی و منتقل کنیم، صرفاً برای اهداف اجرا، ایمن‌سازی، پشتیبانی، بازبینی و بهبود سرویس.

محدودیت‌های این مجوز

• ما بدون اجازه صریح و جداگانه شما، از محتوای شما در تبلیغات یا تبلیغ استفاده نمی‌کنیم و آن را به هیچ شخص ثالثی برای اهداف خودش واگذار نمی‌کنیم
• ما از محتوای شما برای آموزش مدل‌های عمومی هوش مصنوعی اشخاص ثالث استفاده نمی‌کنیم و تأمین‌کنندگان بازبینی محتوای ما نیز طبق قرارداد از این کار منع شده‌اند
• این مجوز با حذف محتوا یا حساب شما پایان می‌یابد، جز در این موارد: نسخه‌هایی که در پشتیبان‌های رمزنگاری‌شده معمول تا زمان انقضای آن‌ها باقی می‌مانند؛ محتوایی که قبلاً برای کاربر دیگری فرستاده‌اید و طبق توضیح سیاست حفظ حریم خصوصی در صندوق پیام او می‌ماند؛ و سوابقی که باید برای اهداف ایمنی، قانونی یا اجرای قانون نگه داریم

تعهدات شما درباره محتوا

شما اعلام و تضمین می‌کنید که مالک محتوای خود هستید یا حقوق لازم را دارید و محتوای شما حقوق هیچ‌کس را نقض نمی‌کند. شما نمی‌توانید محتوایی منتشر کنید که توهین‌آمیز، عمداً نادرست، سوءاستفاده‌آمیز، زشت، رکیک، تهدیدآمیز، ترساننده، آزاردهنده، نژادپرستانه یا غیرقانونی باشد، یا حقوق شخص دیگری را نقض کند.

ما می‌توانیم به تشخیص خود هر محتوایی را حذف کنیم یا نپذیریم و تعهدی به نگهداری یا بازگرداندن محتوای شما نداریم.

🚫 فعالیت‌های ممنوع

ما حق داریم در صورت سوءاستفاده از سرویس یا رفتار نامناسب، حساب شما را بررسی، تعلیق و حذف کنیم. شما مجاز نیستید:

• هویت هیچ شخص یا نهادی را جعل کنید یا از عکس‌هایی استفاده کنید که متعلق به شما نیست
• از کاربران پول، هدیه، ارز دیجیتال یا اطلاعات مالی درخواست کنید، یا کلاهبرداری عاطفی، کلاهبرداری پیش‌پرداخت، فیشینگ یا کلاهبرداری سرمایه‌گذاری انجام دهید
• فعالیت جنسی تجاری، تن‌فروشی، خدمات اسکورت یا قاچاق جنسی را تبلیغ، درخواست یا ترتیب دهید. این کار مطلقاً ممنوع است و به مراجع انتظامی گزارش می‌شود
• در قاچاق انسان یا بهره‌کشی جنسی از هر فردی مشارکت یا آن را تسهیل کنید
• از سرویس به هر شکلی برای به خطر انداختن کودکان استفاده کنید، از جمله آماده‌سازی (grooming)، جنسی‌سازی صغیر، اخاذی جنسی یا انتشار محتوای سوءاستفاده جنسی از کودکان
• تصاویر خصوصی هر فردی را بدون رضایت او منتشر کنید، به انتشار آن تهدید کنید یا آن را درخواست کنید
• اسپم بفرستید، پیام‌رسانی انبوه کنید، از ربات یا فعالیت اسکریپتی استفاده کنید، یا حساب جعلی یا متعدد بسازید
• در پیام‌ها لینک یا نشانی وب بفرستید. لینک در چت مجاز نیست
• هر فردی را تعقیب، آزار، قلدری، تهدید یا مرعوب کنید
• نفرت‌پراکنی کنید یا محتوایی منتشر کنید که خشونت، تروریسم، خودآزاری یا مواد و سلاح غیرقانونی را ترویج کند
• از سرویس به شکل غیرقانونی یا برخلاف قوانین قابل اعمال بر خودتان استفاده کنید
• نام کاربری یا ایمیل برای ارتباطات ناخواسته جمع‌آوری کنید، یا داده‌های سرویس را استخراج یا برداشت کنید
• در سرویس یا سامانه‌های آن اختلال ایجاد کنید، آن را بیش از حد بار بگذارید، کاوش کنید یا برای دسترسی غیرمجاز تلاش کنید
• ویروس، بدافزار یا کد مخرب دیگر منتقل کنید
• هر بخش از سرویس را مهندسی معکوس، دیکامپایل یا جداسازی کنید، مگر در جایی که قانون این محدودیت را ممنوع کرده باشد
• از تعلیق یا ممنوعیت فرار کنید، از جمله با ساخت حساب جدید یا استفاده از دستگاه، شبکه یا آدرس ایمیل دیگر

تخلفات می‌تواند به حذف محتوا، محدودشدن امکانات، تعلیق یا خاتمه حساب بدون بازپرداخت و ارجاع به مراجع انتظامی منجر شود.

🛡️ سیاست ایمنی و حفاظت از کودکان

Tolu بهره‌کشی و سوءاستفاده جنسی از کودکان (CSAE) را اکیداً ممنوع می‌کند. ما هر استفاده‌ای از سرویس که کودکی را به خطر بیندازد ممنوع می‌کنیم، از جمله:

• تعامل نامناسب هدف‌گرفته به سمت یک کودک
• آماده‌سازی کودک (grooming)، مانند دوست‌شدن آنلاین با کودک برای تسهیل تماس جنسی
• جنسی‌سازی صغیر، از جمله تصاویری که سوءاستفاده جنسی از کودکان را نشان می‌دهد یا ترویج می‌کند
• اخاذی جنسی، مانند تهدید یا باج‌گیری از کودک با استفاده از تصاویر خصوصی
• قاچاق کودک، از جمله تبلیغ یا درخواست برای بهره‌کشی جنسی تجاری

🚨 تصاویر خصوصی بدون رضایت: گزارش و حذف

Tolu انتشار یا تهدید به انتشار تصاویر خصوصی هر فردی را بدون رضایت آن فرد ممنوع می‌کند، از جمله تصاویر ساخته‌شده یا دستکاری‌شده دیجیتالی مانند دیپ‌فیک. این ممنوعیت فارغ از اینکه آن فرد در Tolu حضور داشته باشد یا نه اعمال می‌شود.

نحوه گزارش

اگر تصویر خصوصی شما بدون رضایتتان در Tolu منتشر شده است، با موضوع «NCII REMOVAL REQUEST» به info@tolu.dating ایمیل بزنید و این موارد را درج کنید:

1. نام شما و یک امضای فیزیکی یا الکترونیکی
2. جزئیات کافی برای یافتن تصویر در سرویس، مانند پروفایل، گفتگو یا توضیح محل نمایش آن
3. بیانیه‌ای مبنی بر اینکه شما فرد نشان‌داده‌شده هستید یا نماینده مجاز آن فرد هستید
4. بیانیه‌ای مبنی بر اینکه به انتشار آن تصویر رضایت نداده‌اید
5. اطلاعات تماسی که بتوانیم از طریق آن با شما در ارتباط باشیم

اقدام ما

ما تصویر گزارش‌شده و هر نسخه یکسان شناخته‌شده از آن را در سریع‌ترین زمان ممکن و حداکثر ظرف ۴۸ ساعت پس از دریافت درخواست معتبر حذف می‌کنیم، مطابق با قانون فدرال TAKE IT DOWN. همچنین علیه حسابی که آن را منتشر کرده اقدام می‌کنیم، تا حد حذف دائمی، و در مواردی که قانون الزام کند مدارک را حفظ می‌کنیم.

اگر در خطر فوری هستید با پلیس محل تماس بگیرید. در ایالات متحده می‌توانید با خط بحران Cyber Civil Rights Initiative تماس بگیرید و اگر فرد نشان‌داده‌شده زیر سن قانونی است، از سرویس Take It Down مرکز NCMEC استفاده کنید.

⚖️ سیاست کپی‌رایت (DMCA)

Tolu به حقوق مالکیت فکری احترام می‌گذارد و به اظهارنامه‌های نقض کپی‌رایت طبق قانون کپی‌رایت هزاره دیجیتال (DMCA) رسیدگی می‌کند.

اظهارنامه نقض

اگر فکر می‌کنید اثر شما به گونه‌ای کپی شده که نقض کپی‌رایت است، یک اظهارنامه کتبی با موضوع «DMCA NOTICE» به نماینده تعیین‌شده ما در info@tolu.dating بفرستید که شامل این موارد باشد:

1. امضای فیزیکی یا الکترونیکی مالک کپی‌رایت یا شخص مجاز از طرف او
2. مشخص‌کردن اثر دارای کپی‌رایت که ادعا می‌شود نقض شده است
3. مشخص‌کردن محتوایی که ادعای نقض دارد و اطلاعات کافی برای یافتن آن
4. نشانی، شماره تلفن و آدرس ایمیل شما
5. بیانیه‌ای مبنی بر اینکه با حسن نیت باور دارید این استفاده توسط مالک کپی‌رایت، نماینده او یا قانون مجاز نشده است
6. بیانیه‌ای تحت مسئولیت سوگند مبنی بر اینکه اطلاعات اظهارنامه دقیق است و شما مالک کپی‌رایت یا مجاز از طرف او هستید

ارائه آگاهانه اطلاعات نادرست اساسی در یک اظهارنامه یا اظهارنامه متقابل DMCA می‌تواند شما را طبق ماده ۵۱۲(f) از عنوان ۱۷ قوانین ایالات متحده مسئول خسارت کند.

اظهارنامه متقابل

اگر محتوای شما حذف شد و باور دارید که به اشتباه یا از روی شناسایی نادرست حذف شده است، می‌توانید اظهارنامه متقابلی به همان نشانی بفرستید که شامل این موارد باشد: امضای شما؛ مشخص‌کردن محتوا و محل نمایش آن پیش از حذف؛ بیانیه‌ای تحت مسئولیت سوگند مبنی بر اینکه با حسن نیت باور دارید محتوا به اشتباه یا شناسایی نادرست حذف شده است؛ نام، نشانی و شماره تلفن شما؛ و بیانیه‌ای مبنی بر پذیرش صلاحیت دادگاه فدرال منطقه محل سکونت شما، یا اگر خارج از ایالات متحده هستید، یک دادگاه فدرال منطقه در تگزاس، و پذیرش ابلاغ از سوی طرف شاکی.

اگر اظهارنامه متقابل معتبری دریافت کنیم، ممکن است ظرف ۱۰ تا ۱۴ روز کاری محتوا را بازگردانیم، مگر آنکه طرف شاکی به ما اطلاع دهد که برای دریافت دستور دادگاه اقامه دعوا کرده است.

ناقضان مکرر

ما در شرایط مقتضی، حساب کاربرانی را که به‌طور مکرر ناقض کپی‌رایت هستند خاتمه می‌دهیم.

🔚 مدت و خاتمه

این توافقنامه تا زمانی که از سرویس استفاده می‌کنید یا حساب دارید معتبر است. شما می‌توانید هر زمان و به هر دلیل، از بخش «تنظیمات» در سرویس، پروفایل خود را متوقف یا حساب خود را حذف کنید.

ما می‌توانیم هر زمان، با یا بدون اطلاع قبلی، حساب شما را تعلیق، محدود، ممنوع یا خاتمه دهیم، اگر به‌طور معقول باور داشته باشیم این توافقنامه را نقض کرده‌اید، اگر رفتار شما سایر کاربران یا سرویس را در معرض خطر قرار دهد، یا اگر قانون الزام کند. در جایی که عملی و قانونی باشد، دلیل را به شما می‌گوییم و شما می‌توانید با ارسال ایمیل به info@tolu.dating اعتراض کنید.

🗑️ درخواست حذف داده‌ها

شما می‌توانید حساب خود را از بخش تنظیمات در سرویس حذف کنید. اگر به حساب خود دسترسی ندارید، با ایمیل درخواست حذف بدهید.

1. یک ایمیل با عنوان «DATA DELETION REQUEST» به info@tolu.dating بفرستید
2. آدرس ایمیل حساب خود و هر آدرس ایمیل دیگری که ممکن است استفاده کرده باشید را درج کنید

حذف از داخل برنامه معمولاً فوری است. رسیدگی به درخواست‌های ایمیلی ممکن است بیشتر طول بکشد. سیاست حفظ حریم خصوصی ما به‌تفصیل توضیح می‌دهد چه چیزی حذف می‌شود، چه چیزی نگه داشته می‌شود و چرا، از جمله این واقعیت که پیام‌هایی که قبلاً فرستاده‌اید برای گیرنده باقی می‌مانند.

⚖️ سلب مسئولیت

تا حداکثری که قانون قابل اعمال اجازه می‌دهد، شرکت سرویس را «همان‌گونه که هست» و «همان‌گونه که در دسترس است» ارائه می‌کند و هیچ ضمانتی از هر نوع، چه صریح، ضمنی، قانونی یا غیر آن، نسبت به سرویس نمی‌دهد. شرکت به‌طور مشخص هرگونه ضمانت ضمنی قابلیت فروش، تناسب برای هدفی خاص و عدم نقض حقوق را سلب می‌کند.

شرکت اظهار یا تضمین نمی‌کند که سرویس بدون وقفه، امن یا بدون خطا خواهد بود، که نقص‌ها برطرف خواهند شد، که هیچ Match یا آشنایی‌ای برقرار خواهد شد، یا اینکه هر کاربر همان کسی است که ادعا می‌کند.

برخی حوزه‌های قضایی اجازه استثنای برخی ضمانت‌ها را نمی‌دهند. در آن مناطق، بخشی از استثنائات بالا ممکن است بر شما اعمال نشود و ممکن است حقوق بیشتری داشته باشید.

💼 محدودیت مسئولیت

تا حداکثری که قانون اجازه می‌دهد، شرکت و اعضا، مدیران، مقامات، کارکنان، نمایندگان و ارائه‌دهندگان خدمات آن، مسئول هیچ خسارت غیرمستقیم، اتفاقی، خاص، تبعی، نمونه‌ای یا تنبیهی، و هیچ زیان ناشی از از دست رفتن سود، درآمد، داده، اعتبار تجاری یا سایر زیان‌های نامشهود، که ناشی از استفاده یا ناتوانی شما در استفاده از سرویس باشد، نخواهند بود، حتی اگر به ما درباره احتمال چنین خساراتی اطلاع داده شده باشد.

تا حداکثری که قانون اجازه می‌دهد، مجموع مسئولیت کلی ما در برابر شما بابت تمام دعاوی مرتبط با سرویس، از هرکدام از این دو مبلغ که بیشتر باشد فراتر نخواهد رفت: (الف) مبلغی که در دوازده (۱۲) ماه پیش از رویداد موجب دعوا به ما، یا بابت Tolu به اپل یا گوگل، پرداخته‌اید، یا (ب) یکصد دلار آمریکا (۱۰۰ دلار).

این محدودیت‌ها فارغ از مبنای حقوقی دعوا اعمال می‌شوند و شامل مسئولیتی که طبق قانون قابل استثنا یا محدودسازی نیست نمی‌شوند، از جمله مسئولیت ناشی از قصور فاحش، سوءرفتار عمدی یا تقلب خود ما. برخی حوزه‌های قضایی اجازه استثنا یا محدودسازی خسارات اتفاقی یا تبعی را نمی‌دهند، پس ممکن است بخشی از موارد بالا بر شما اعمال نشود.

🤝 جبران خسارت

شما موافقت می‌کنید Tachara LLC و اعضا، مدیران، مقامات، کارکنان و نمایندگان آن را در برابر هر دعوا، مطالبه، زیان، مسئولیت، خسارت، هزینه یا مخارج، از جمله حق‌الوکاله معقول، که ناشی از این موارد باشد یا به آن‌ها مربوط شود، جبران کنید، از آن‌ها دفاع کنید و آن‌ها را مصون نگه دارید: محتوای شما؛ استفاده شما از سرویس؛ نقض این شرایط یا هر قانون توسط شما؛ نقض حقوق شخص دیگری توسط شما؛ یا هر تعامل، اختلاف یا ملاقات بین شما و کاربر دیگر.

ما این حق را داریم که دفاع و کنترل انحصاری هر موضوع مشمول جبران خسارت توسط شما را با هزینه شما بر عهده بگیریم و شما موافقت می‌کنید که در دفاع ما همکاری کنید.

🇺🇸 افشاگری‌های ایالتی ایالات متحده

بررسی سابقه

چند ایالت، از جمله کالیفرنیا، فلوریدا، میشیگان، نیویورک، نیوجرسی، ایلینوی و تگزاس، افشاگری‌های مشخصی درباره بررسی سوابق توسط سرویس‌های دوستیابی الزام می‌کنند:

Tolu بررسی سوابق کیفری کاربران خود را انجام نمی‌دهد. ما کاربران را در پایگاه‌های داده مجرمین جنسی بررسی نمی‌کنیم. لطفاً در تمام تعاملات محتاط باشید.

کالیفرنیا: حق لغو قرارداد

اگر ساکن کالیفرنیا هستید، می‌توانید این قرارداد را بدون جریمه یا تعهد، در هر زمان پیش از نیمه‌شب سومین روز کاری پس از تاریخ ثبت‌نام در سرویس، لغو کنید. برای لغو، حساب خود را در بخش تنظیمات حذف کنید یا به info@tolu.dating ایمیل بزنید.

اگر اشتراک ماهانه را از Apple App Store یا Google Play خریده‌اید، لغو این قرارداد یا حذف حساب Tolu ممکن است تمدید فروشگاهی را متوقف نکند. برای توقف شارژهای بعدی باید اشتراک را در همان فروشگاهی که از آن خرید کرده‌اید لغو کنید.

کالیفرنیا: شکایت مصرف‌کننده

طبق بخش ۱۷۸۹.۳ قانون مدنی کالیفرنیا، ساکنان کالیفرنیا می‌توانند با واحد کمک به شکایات اداره خدمات مصرف‌کننده وابسته به اداره امور مصرف‌کنندگان کالیفرنیا به نشانی 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834 یا شماره تلفن (800) 952-5210 تماس بگیرند.

افشاگری‌های تمدید خودکار

در جایی که قانون تمدید خودکار ایالت شما اعمال می‌شود، شرایط اشتراک، دوره تمدید، قیمت و روش لغو در بالا افشا شده و همچنین پیش از تکمیل خرید توسط Apple App Store یا Google Play به شما نمایش داده می‌شود.

🌐 کنترل صادرات و تحریم‌ها

Tolu یک سرویس ارتباطات شخصی است که از ایالات متحده اداره می‌شود و مشمول قوانین کنترل صادرات و تحریم‌های اقتصادی ایالات متحده، از جمله مقررات اداره کنترل دارایی‌های خارجی (OFAC)، است.

Tolu به‌عنوان یک سرویس ارتباطات شخصی رایگان یا کم‌هزینه ارائه می‌شود و ما آن را در حدی که مجوزهای عمومی و معافیت‌های قابل اعمال ایالات متحده برای ارتباطات شخصی اجازه می‌دهند، به‌صورت بین‌المللی در دسترس قرار می‌دهیم.

شما اعلام می‌کنید که در هیچ فهرست اشخاص محدودشده دولت ایالات متحده قرار ندارید، از طرف هیچ دولت تحریم‌شده‌ای عمل نمی‌کنید و از سرویس برای هیچ هدفی که قانون ایالات متحده ممنوع کرده استفاده نخواهید کرد. ما می‌توانیم در جایی که رعایت قوانین تحریم یا صادرات ایجاب کند، دسترسی را محدود یا خاتمه دهیم.

شما همچنین مسئول رعایت قوانین کشوری هستید که در آن قرار دارید. برخی کشورها دسترسی به سرویس‌های دوستیابی و به برخی محتواها را محدود می‌کنند. استفاده از سرویس در جایی که ممنوع است به مسئولیت خودتان و نقض این شرایط است.

🍎 شرایط Apple App Store

اگر اپلیکیشن Tolu را از Apple App Store دریافت کرده‌اید، موارد زیر اعمال می‌شود:

• این توافقنامه فقط بین شما و Tachara LLC است، نه با اپل. Tachara LLC، و نه اپل، تنها مسئول اپلیکیشن Tolu و محتوای آن است
• اپل هیچ تعهدی به ارائه نگهداری یا پشتیبانی برای اپلیکیشن ندارد
• اگر اپلیکیشن با ضمانت قابل اعمالی مطابقت نداشته باشد، می‌توانید به اپل اطلاع دهید و اپل مبلغ خرید اپلیکیشن (در صورت وجود) را بازپرداخت می‌کند. تا حداکثری که قانون اجازه می‌دهد، اپل هیچ تعهد ضمانت دیگری نسبت به اپلیکیشن ندارد
• Tachara LLC، و نه اپل، مسئول رسیدگی به هر دعوای مرتبط با اپلیکیشن است، از جمله دعاوی مسئولیت محصول، دعاوی عدم انطباق با الزامات قانونی و دعاوی مبتنی بر قوانین حمایت از مصرف‌کننده یا حریم خصوصی
• Tachara LLC، و نه اپل، مسئول بررسی، دفاع، مصالحه و رفع هر دعوای شخص ثالث مبنی بر نقض حقوق مالکیت فکری توسط اپلیکیشن است
• شما اعلام می‌کنید که در کشوری مشمول تحریم دولت ایالات متحده یا کشوری که «حامی تروریسم» تعیین شده قرار ندارید و در هیچ فهرست اشخاص ممنوع یا محدودشده دولت ایالات متحده نیستید
• اپل و شرکت‌های تابعه آن ذی‌نفع ثالث این توافقنامه هستند و با پذیرش شما، حق اجرای آن را علیه شما به‌عنوان ذی‌نفع ثالث خواهند داشت

🏛️ حل اختلاف

لطفاً این بخش را با دقت بخوانید. این بخش بر حقوق قانونی شما اثر می‌گذارد، از جمله حق شما برای مراجعه به دادگاه و محاکمه با هیئت منصفه، و حق شما برای اقامه یا شرکت در دعوای گروهی.

قانون حاکم

این شرایط و هر اختلاف ناشی از آن‌ها یا از سرویس، تابع قوانین ایالت تگزاس، بدون در نظر گرفتن قواعد تعارض قوانین آن، و قوانین فدرال قابل اعمال ایالات متحده است. قانون داوری فدرال (FAA) بر توافقنامه داوری حاکم است. این انتخاب قانون، شما را از حمایت هیچ قانون آمره حمایت از مصرف‌کننده در ایالت یا کشور محل سکونتتان محروم نمی‌کند.

گام اول: ابتدا حل غیررسمی

پیش از شروع داوری یا هر اقدام حقوقی، موافقت می‌کنید که ابتدا تلاش کنید اختلاف را به‌صورت غیررسمی با ما حل کنید. یک اطلاعیه کتبی با موضوع «DISPUTE NOTICE» به info@tolu.dating بفرستید که در آن اختلاف، خواسته شما و ایمیل حسابتان را توضیح دهید. ما هم برای هر اختلافی که با شما داشته باشیم همین کار را می‌کنیم. هر دو طرف موافقت می‌کنند به مدت ۶۰ روز با حسن نیت مذاکره کنند. این گام شرط شروع داوری است و مرور زمان در طول آن متوقف می‌ماند. این شرط مانع گزارش به نهادهای دولتی، درخواست حذف محتوای غیرقانونی، مراجعه به دادگاه دعاوی کوچک یا درخواست فوری دستور موقت نمی‌شود.

گام دوم: داوری فردی الزام‌آور

اگر اختلاف ظرف ۶۰ روز حل نشود، از طریق داوری فردی الزام‌آور که توسط انجمن داوری آمریکا (AAA) و طبق قواعد داوری مصرف‌کننده آن اداره می‌شود حل خواهد شد، نه در دادگاه.

• داوری توسط یک داور انجام می‌شود
• مگر آنکه شما و ما طور دیگری توافق کنیم، داوری در شهرستان محل سکونت شما، یا از طریق تلفن یا ویدیوکنفرانس، یا صرفاً بر اساس اسناد در جایی که قواعد AAA اجازه دهد، برگزار می‌شود
• داور می‌تواند همان جبران فردی را که دادگاه می‌توانست حکم کند صادر کند، از جمله خسارت قانونی و حق‌الوکاله در جایی که قانون آن را پیش‌بینی کرده باشد
• رأی داور نهایی و الزام‌آور است و حکم مبتنی بر آن در هر دادگاه صالحی قابل ثبت است
• هزینه‌ها تابع قواعد داوری مصرف‌کننده AAA است. سهم هزینه ثبت شما از مبلغ کمتر میان سقف تعیین‌شده توسط AAA و هزینه ثبت دعوا در دادگاه بیشتر نخواهد بود. ما هزینه‌های باقی‌مانده ثبت، اداری و حق‌الزحمه داور را می‌پردازیم. هرگونه تغییر در تقسیم هزینه‌ها فقط در حدودی مجاز است که قواعد AAA و قانون قابل اعمال اجازه دهند

مواردی که مشمول داوری نیستند

• هر طرف می‌تواند دعوای فردی خود را در دادگاه دعاوی کوچک اقامه کند، اگر شرایط آن را داشته باشد
• هر طرف می‌تواند برای حفاظت از حقوق مالکیت فکری یا توقف دسترسی غیرمجاز به سرویس، از دادگاه درخواست دستور موقت یا جبران انصافی کند
• هیچ‌چیز در این بخش مانع شما از گزارش رفتار به یک نهاد دولتی یا درخواست جبران از آن نمی‌شود، از جمله دادستان کل ایالت یا کمیسیون تجارت فدرال (FTC)
• دعاوی مربوط به تعرض جنسی یا آزار جنسی، تا حدی که قانون فدرال «پایان‌دادن به داوری اجباری تعرض و آزار جنسی» مصوب ۲۰۲۱ الزام می‌کند، از داوری اجباری مستثنا هستند و می‌توانید چنین دعوایی را در دادگاه اقامه کنید

سلب حق دعوای گروهی و محاکمه با هیئت منصفه

شما و Tachara LLC موافقت می‌کنید که هر رسیدگی حل اختلاف صرفاً بر مبنای فردی انجام شود و نه به‌صورت دعوای گروهی، تجمیعی، جمعی یا نمایندگی. داور نمی‌تواند دعاوی بیش از یک نفر را تجمیع کند و نمی‌تواند بر هیچ شکلی از رسیدگی نمایندگی ریاست کند. شما و شرکت همچنین حق محاکمه با هیئت منصفه را برای اختلافاتی که در دادگاه رسیدگی می‌شوند سلب می‌کنید.

اگر دادگاهی تشخیص دهد که سلب حق دعوای گروهی نسبت به دعوای خاصی، یا نسبت به درخواست دستور موقت عمومی، غیرقابل اجراست، آن دعوا یا درخواست مشخص از داوری تفکیک شده و در دادگاه رسیدگی می‌شود و سایر دعاوی همچنان به داوری ارجاع می‌شوند.

حق شما برای انصراف از داوری

شما می‌توانید از این توافقنامه داوری انصراف دهید. ظرف ۳۰ روز از اولین پذیرش این شرایط، با موضوع «ARBITRATION OPT-OUT» به info@tolu.dating ایمیل بزنید و نام و آدرس ایمیل حسابتان را درج کنید. انصراف هیچ اثری بر حساب، اشتراک یا هیچ بخش دیگری از این شرایط ندارد. اگر انصراف دهید، اختلافات در دادگاه‌های ایالتی یا فدرال واقع در تگزاس حل می‌شوند و شما و شرکت صلاحیت شخصی و محل رسیدگی آن دادگاه‌ها را با رعایت استثناهای بند بعدی می‌پذیرید.

محل رسیدگی برای دعاوی خارج از داوری

هر اختلافی که مشمول داوری نباشد، منحصراً در دادگاه‌های ایالتی یا فدرال واقع در ایالت تگزاس اقامه می‌شود و شما و شرکت صلاحیت شخصی آن دادگاه‌ها را می‌پذیرید، مگر آنکه قانون آمره به شما حق رسیدگی در محل دیگری بدهد. این بند حق هیچ‌یک از طرفین برای مراجعه به دادگاه دعاوی کوچک صالح را محدود نمی‌کند.

بقا و تفکیک‌پذیری

این بخش حل اختلاف پس از خاتمه حساب شما و این توافقنامه نیز معتبر می‌ماند. اگر هر بخشی از آن، جز سلب حق دعوای گروهی، غیرقابل اجرا تشخیص داده شود، آن بخش تفکیک شده و بقیه معتبر می‌ماند. اگر خود سلب حق دعوای گروهی نسبت به تمام دعاوی غیرقابل اجرا تشخیص داده شود، کل این توافقنامه داوری باطل است و اختلافات در دادگاه‌های تگزاس که در بالا مشخص شده حل می‌شوند.

📄 مقررات عمومی

• کلیت توافقنامه: این شرایط، همراه با سیاست حفظ حریم خصوصی و سیاست ایمنی کودکان، کل توافق بین شما و شرکت درباره سرویس است و جایگزین هر توافق قبلی در این موضوع می‌شود

Welcome to Tolu, operated by Tachara LLC, a Texas limited liability company ("Company," "Tolu," "we," "our," or "us"). These Terms of Service ("Terms") constitute a binding legal agreement between you and Tachara LLC governing your use of the Tolu website, web app, and mobile apps (the "Service").

By creating an account or accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read Section "Dispute Resolution" carefully. It requires most disputes to be resolved by individual binding arbitration rather than in court, and it waives your right to a jury trial and to participate in a class action. You have 30 days from first accepting these Terms to opt out of arbitration, and doing so will not affect your account in any way.

You should also read our Privacy Policy, which is incorporated into these Terms, and our Child Safety Policy.

For iOS users, use of the Tolu app is also subject to the Apple Standard Licensed Application End User License Agreement. Where these Terms conflict with that agreement, these Terms control except where Apple's terms must prevail.

🤠 Texas Internet Dating Safety Act Disclosures

Tachara LLC is a Texas company and Tolu is an online dating service under the Texas Internet Dating Safety Act (Texas Business & Commerce Code Chapter 106). The following disclosures are provided to all members, including Texas members.

Background Check Disclosure

Attention: Tachara LLC does not conduct criminal background checks on its members. We do not screen members against sex offender registries or any criminal record database. A member you meet on Tolu may have a criminal history.

Safety Awareness Notification

Criminal background screenings are not foolproof even where they are performed, and they do not guarantee anyone's safety. You should always take your own precautions:

• Do not include your last name, home address, workplace, or daily routine in your profile or in early messages
• Do not send money, gift cards, cryptocurrency, or financial account details to anyone you meet on Tolu, no matter what story they give you
• Be suspicious of anyone who quickly professes love, refuses a video call, claims to be traveling or working overseas, or asks to move the conversation off Tolu right away
• Video chat before meeting in person, and search the person's photos and details online
• Meet in a public place for the first several dates, and arrange your own transportation both ways
• Tell a friend or family member where you are going, who you are meeting, and when you expect to be back. Share your live location with them
• Stay sober and keep control of your drink and your phone
• If anything feels wrong, leave. You do not owe anyone an explanation
• Block and report anyone who pressures, threatens, or harasses you, and contact local law enforcement if you are in danger. In an emergency in the United States, call 911

Fraud and Identity Theft Awareness

Never share your password, one-time login codes, government identification, banking details, or intimate images with anyone you meet online. Tolu staff will never ask you for your password or for payment outside of the Apple App Store or Google Play.

✅ Acceptance of Terms

These Terms are a contract between you and Tachara LLC that establish the legally binding terms you must accept to use the Service. This Agreement includes our Privacy Policy, our Child Safety Policy, and any additional terms disclosed to and accepted by you when you purchase or use additional features, products, or services.

By accessing or using the Service, you accept this Agreement, agree to the terms, conditions, and notices contained or referenced in it, and consent to receive this Agreement and all notices in electronic form.

Our Privacy Policy explains how we use your account, device, approximate location, and content information. Accepting these Terms does not replace any separate consent required by law.

🔄 Changes to These Terms

We may modify these Terms. If a change is material, we will provide at least 30 days' notice before it takes effect, by email or by an in-app notice, and we will update the "Last Updated" date. Non-material changes take effect when posted.

Your continued use of the Service after a change takes effect means you accept the revised Terms. If you do not accept them, delete your account before the effective date. Changes to the Dispute Resolution section apply only to claims that arise after the effective date of the change.

🔞 Eligibility

You must be at least 18 years old to use Tolu. No part of the Service is directed to anyone under 18, and any use of the Service is void where prohibited.

By accessing and using the Service, you represent and warrant that:

• You are eighteen (18) years of age or older and legally able to enter into this Agreement
• Your date of birth and other registration information are true and accurate
• You have never been convicted of, or pled no contest to, a felony, a sex crime, or any crime involving violence
• You are not required to register as a sex offender with any government sex offender registry
• You do not have more than one account on the Service
• You have not previously been removed from the Service by us, unless you have our express written permission to create a new account
• You are not located in, and are not a resident of, a country or region, and are not a person or entity, subject to United States sanctions that would prohibit us from providing you the Service

We rely on your representation of age, on the age ratings and any age category signals provided by the Apple App Store and Google Play, and on our own automated and manual review. Misrepresenting your age is a material breach of this Agreement and will result in immediate termination.

👤 Account Registration

To use the Service you must register using a method we provide. You authorize us to access and use certain account information in accordance with our Privacy Policy.

You represent and warrant that all information you provide in connection with your account is current, complete, and accurate, and that you will keep it accurate. You further represent that you are not impersonating any person or entity, and that photos on your profile genuinely depict you.

You acknowledge that we may log and analyze your IP address, device identifier, and usage patterns, and may review photos, messages, media, and other in-app content automatically or manually as reasonably necessary to protect the Service and its users, investigate reports, prevent spam and fraud, and enforce these Terms. See the Privacy Policy for details on the moderation providers we use.

👤 Personal Use Only

You may not use anyone else's account at any time. You may not buy, sell, rent, or lease access to your account or your username, and you will not share or transfer your account credentials.

Your account and the Service are for your personal, non-commercial use only, and may not be used in connection with commercial endeavors, such as:

• Advertising or soliciting any user to buy or sell products or services not offered by Company
• Soliciting others to attend parties or social functions, or networking, for commercial purposes
• Promoting another platform, service, business, channel, or fundraising effort
• Scraping, crawling, harvesting, or otherwise collecting profiles, photos, or content, whether manually or by automated means, including for the purpose of training any machine learning or artificial intelligence model

🔐 Account Security

You are responsible for maintaining the confidentiality of your login credentials, and you are solely responsible for all activity that occurs under your account.

Notify us immediately at info@tolu.dating of any disclosure or unauthorized use of your credentials or any other breach of security.

💳 Monthly Paid Subscription

Tolu offers optional paid features, such as Tolu Plus / Premium. The paid Tolu subscription is a monthly auto-renewing subscription and may include unlimited swipes, unlimited messaging, seeing who liked you, seeing profile visitors, filtering who can message you and who can discover you, and boosted profile placement.

Price, billing, and renewal

• The subscription is purchased and managed through the Apple App Store or Google Play. Tolu does not process your payment and never receives your full card details
• The monthly price and billing period are displayed by the applicable storefront before you confirm the purchase
• Payment is charged to your storefront account at confirmation of purchase
• The subscription renews automatically each month at the then-current price unless you cancel, and your account is charged for renewal within 24 hours before the end of the current period
• To avoid being charged, cancel at least 24 hours before the end of the current billing period

How to cancel

Cancel at any time in your Apple App Store or Google Play account settings, under Subscriptions. Cancellation takes effect at the end of the current billing period, and you keep the paid features until then.

Deleting your Tolu account does not cancel your storefront subscription. To stop future charges you must cancel the subscription in the storefront where you bought it.

Free trials

We may offer a one-time free trial of paid features. Unless you cancel before the trial ends, the trial converts into a paid monthly subscription at the then-current price. A free trial may be used only once per person, and we may withdraw or modify trial offers at any time.

Refunds

Because Apple and Google process the payment, refunds are handled by them under their own policies, and Tolu cannot issue a refund for a storefront purchase. Request refunds through Apple or Google. Nothing here limits any non-waivable refund or cancellation right you have under the law of your state or country, including the California cancellation right described below.

Paid features and virtual items

Paid features, boosts, and any other virtual item are a limited, personal, non-transferable, revocable license to use a feature of the Service. They are not property, have no cash value, are not redeemable for money, and cannot be sold, traded, or transferred. Unused features do not carry over after cancellation, and we may change or discontinue a paid feature, with notice where a change is material.

⚠️ Safety - Your Interactions with Other Users

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. YOU UNDERSTAND THAT WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR IDENTITY SCREENINGS ON USERS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS, THE TRUTH OF WHAT THEY SAY ABOUT THEMSELVES, OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS.

Company is not responsible for the conduct of any user, online or offline. You assume all responsibility for your communications and interactions initiated through the Service and for any decision to meet another user in person.

We provide tools in the app to block and report users who violate these Terms or behave offensively. We review reports and take appropriate action, including removing content and suspending accounts, typically within 24 hours.

©️ Intellectual Property

Company owns and retains all proprietary rights in the Service and in all content, trademarks, trade names, service marks, and other intellectual property related to it.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use.

You agree not to copy, modify, transmit, create derivative works from, or reproduce in any way any copyrighted material, trademarks, trade names, service marks, or other proprietary information accessible through the Service, without our prior written consent.

📝 Your Content and the License You Grant Us

You are solely responsible for the content and information you post, upload, publish, link to, transmit, record, display, or otherwise make available on the Service or send to other users, including messages, chat, videos, photographs, voice clips, and profile text ("Content").

You keep ownership of your Content. You do not transfer any ownership to us.

The license

By posting Content on the Service, you grant Company a non-exclusive, worldwide, royalty-free, sublicensable (only to our service providers, such as hosting, media delivery, and moderation providers) license to host, store, cache, copy, reproduce, display, adapt, reformat, and transmit that Content, solely for the purposes of operating, securing, supporting, moderating, and improving the Service.

Limits on the license

• We will not use your Content in advertising or promotion, or license it to any third party for their own purposes, without your separate express permission
• We will not use your Content to train third party general purpose artificial intelligence models, and our moderation providers are contractually restricted from doing so
• This license ends when you delete the Content or your account, except that it survives for: copies retained in routine encrypted backups until they expire; content you already sent to another user, which stays in that user's inbox as explained in our Privacy Policy; and records we must keep for safety, legal, or law enforcement purposes

Your promises about your Content

You represent and warrant that you own or have the necessary rights to your Content, and that it does not infringe anyone's rights. You may not post Content that is offensive, deliberately inaccurate, abusive, obscene, profane, threatening, intimidating, harassing, racially offensive, or illegal, or that infringes or violates another person's rights.

We may remove or refuse any Content at our discretion, and we are not obligated to store or return your Content to you.

🚫 Prohibited Activities

We reserve the right to investigate, suspend, and terminate your account if you misuse the Service or behave inappropriately. You may not:

• Impersonate any person or entity, or use photos that are not of you
• Solicit money, gifts, cryptocurrency, or financial information from any user, or run a romance scam, advance fee scam, phishing, or investment scam
• Advertise, solicit, or arrange commercial sexual activity, prostitution, escort services, or sex trafficking of any kind. This is prohibited absolutely and will be reported to law enforcement
• Engage in or facilitate human trafficking or the sexual exploitation of any person
• Use the Service to endanger a child in any way, including grooming, sexualizing a minor, sextortion, or sharing child sexual abuse material
• Share, threaten to share, or solicit intimate images of any person without that person's consent
• Send spam, conduct bulk messaging, use bots or scripted activity, or create fake or multiple accounts
• Send links or URLs in messages. Links are not permitted in chat
• Stalk, harass, bully, threaten, or intimidate any person
• Post hate speech, or content that promotes violence, terrorism, self-harm, or an illegal substance or weapon
• Use the Service in an illegal manner or in violation of the laws that apply to you
• Collect usernames or email addresses for unsolicited communications, or scrape or harvest data from the Service
• Interfere with, disrupt, overload, probe, or attempt to gain unauthorized access to the Service or its systems
• Transmit viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any portion of the Service, except where that restriction is prohibited by law
• Evade a suspension or ban, including by creating a new account or using another device, network, or email address

Violations may result in content removal, feature restriction, account suspension or termination without refund, and referral to law enforcement.

🛡️ Child Safety Policy

Tolu strictly prohibits Child Sexual Abuse and Exploitation (CSAE). We prohibit any use of the Service that endangers a child, including but not limited to:

• Inappropriate interaction targeted at a child
• Child grooming, such as befriending a child online to facilitate sexual contact
• Sexualization of a minor, including imagery that depicts or promotes the sexual abuse of children
• Sextortion, such as threatening or blackmailing a child using intimate images
• Trafficking of a child, including advertising or solicitation for commercial sexual exploitation

Content containing child sexual abuse material (CSAM) is reported to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A, and we cooperate with law enforcement. Accounts involved are removed permanently and their identifying details are retained to prevent the account from being recreated.

🚨 Non-Consensual Intimate Imagery: Report and Removal

Tolu prohibits the publication or threatened publication of intimate images of any person without that person's consent, including digitally created or altered images such as deepfakes. This is prohibited whether or not the person appears on Tolu.

How to report

If an intimate image of you was shared on Tolu without your consent, email info@tolu.dating with the subject line "NCII REMOVAL REQUEST" and include:

1. Your name and a physical or electronic signature
2. Enough identifying detail to locate the image on the Service, such as the profile, the conversation, or a description of where it appears
3. A statement that you are the person depicted, or an authorized representative of that person
4. A statement that you did not consent to the image being published
5. Contact information where we can reach you

What we do

We will remove the reported image, and any identical known copies, as soon as possible and no later than 48 hours after receiving a valid request, consistent with the federal TAKE IT DOWN Act. We will also take action against the account that posted it, up to permanent removal, and we will preserve evidence where the law requires it.

If you are in immediate danger, contact local law enforcement. In the United States you can also reach the Cyber Civil Rights Initiative crisis helpline and, if the person depicted is a minor, NCMEC's Take It Down service.

⚖️ DMCA Copyright Policy

Tolu respects intellectual property rights and responds to notices of alleged infringement under the Digital Millennium Copyright Act.

Notice of infringement

If you believe your work has been copied in a way that constitutes copyright infringement, send a written notice to our designated agent at info@tolu.dating with the subject "DMCA NOTICE", including:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material claimed to be infringing and enough information for us to locate it
4. Your address, telephone number, and email address
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

Knowingly making a material misrepresentation in a DMCA notice or counter notice can make you liable for damages under 17 U.S.C. § 512(f).

Counter notification

If your content was removed and you believe it was removed by mistake or misidentification, you may send a counter notice to the same address including: your signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the district where you live, or if you are outside the United States, of a federal district court in Texas, and that you will accept service of process from the complaining party.

If we receive a valid counter notice, we may restore the material in 10 to 14 business days unless the complaining party notifies us that it has filed an action seeking a court order.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

🔚 Term and Termination

This Agreement remains in effect while you use the Service or have an account. You may pause your profile or delete your account at any time, for any reason, from "Settings" in the Service.

We may suspend, restrict, ban, or terminate your account at any time, with or without notice, if we reasonably believe you have breached this Agreement, if your conduct puts other users or the Service at risk, or if required by law. Where practical and lawful, we will tell you the reason and you may appeal by emailing info@tolu.dating.

If your account is terminated for a violation, you may not create a new account, and we retain the identifying details necessary to enforce that. Termination does not entitle you to a refund of any amount already paid to Apple or Google, except where required by law.

Sections that by their nature should survive termination do survive it, including Your Content (as limited above), Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and the General provisions.

🗑️ Requesting Deletion of Your Data

You can delete your account from Settings in the Service. If you cannot access your account, email us to request deletion.

1. Send an email titled "DATA DELETION REQUEST" to info@tolu.dating
2. Include the email address on your account, and any other email addresses you may have used

In-app deletion is normally immediate. Email requests may take longer. Our Privacy Policy explains in detail what is deleted, what is kept, and why, including the fact that messages you already sent remain visible to the person who received them.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, COMPANY PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SERVICE. COMPANY SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

COMPANY DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, THAT ANY MATCH OR INTRODUCTION WILL BE MADE, OR THAT ANY USER IS WHO THEY CLAIM TO BE.

Some jurisdictions do not allow the exclusion of certain warranties. In those places, some of the above exclusions may not apply to you, and you may have additional rights.

💼 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, OR PAID TO APPLE OR GOOGLE FOR TOLU, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

These limitations apply regardless of the legal theory, and they do not apply to liability that cannot be excluded or limited by law, including liability for our own gross negligence, willful misconduct, or fraud. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

🤝 Indemnification

You agree to indemnify, defend, and hold harmless Tachara LLC and its members, managers, officers, employees, and agents from and against any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to: your Content; your use of the Service; your breach of these Terms or of any law; your violation of another person's rights; or any interaction, dispute, or meeting between you and another user.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense.

🇺🇸 U.S. State Specific Disclosures

Background Checks

Several states, including California, Florida, Michigan, New York, New Jersey, Illinois, and Texas, require specific disclosures about background screening by dating services:

Tolu does not conduct criminal background checks on its users. We do not verify users against sex offender registries. Please be cautious in all interactions.

California - Right to Cancel

If you are a California resident, you may cancel this agreement, without penalty or obligation, at any time before midnight of the third business day after the date you registered for the Service. To cancel, delete your account in Settings or email info@tolu.dating.

If you bought a monthly subscription through the Apple App Store or Google Play, canceling this agreement or deleting your Tolu account may not stop storefront renewal. To stop future charges, cancel the subscription in the storefront where you purchased it.

California - Consumer Complaints

Under California Civil Code § 1789.3, California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Automatic renewal disclosures

Where your state's automatic renewal law applies, the subscription terms, renewal frequency, price, and cancellation method are disclosed above and are also presented by the Apple App Store or Google Play before you complete a purchase.

🌐 Export Controls and Sanctions

Tolu is a personal communications service operated from the United States and is subject to United States export control and economic sanctions law, including regulations administered by the Office of Foreign Assets Control (OFAC).

Tolu is offered as a no-cost or low-cost personal communications service and we make it available internationally to the extent permitted by applicable U.S. general licenses and exemptions for personal communications.

You represent that you are not on any U.S. government restricted party list, that you are not acting on behalf of a sanctioned government, and that you will not use the Service for any purpose prohibited by U.S. law. We may restrict or terminate access where required to comply with sanctions or export law.

You are also responsible for complying with the laws of the country where you are located. Some countries restrict access to dating services and to certain content. Use of the Service where it is prohibited is at your own risk and is a breach of these Terms.

🍎 Apple App Store Terms

If you obtained the Tolu app from the Apple App Store, the following applies:

• This Agreement is between you and Tachara LLC only, not with Apple. Tachara LLC, not Apple, is solely responsible for the Tolu app and its content
• Apple has no obligation to provide maintenance or support for the app
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app
• Tachara LLC, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection or privacy law
• Tachara LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third party claim that the app infringes intellectual property rights
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third party beneficiaries of this Agreement and, upon your acceptance, will have the right to enforce it against you as a third party beneficiary

🏛️ Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY TRIAL, AND YOUR RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION.

Governing law

These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Texas, without regard to its conflict of law rules, and applicable United States federal law. The Federal Arbitration Act governs the arbitration agreement. This choice of law does not deprive you of the protection of any mandatory consumer law of the state or country where you live.

Step 1: Informal resolution first

Before starting arbitration or any legal proceeding, you agree to try to resolve the dispute with us informally. Send a written notice to info@tolu.dating with the subject "DISPUTE NOTICE" describing the dispute, what you want, and your account email. We will do the same for any dispute we have with you. Both sides agree to negotiate in good faith for 60 days. This step is a condition of starting arbitration, and the statute of limitations is tolled while it runs. This requirement does not delay reports to government agencies, requests to remove unlawful content, small claims proceedings, or requests for urgent injunctive relief.

Step 2: Binding individual arbitration

If the dispute is not resolved within 60 days, it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

• The arbitration will be conducted by one arbitrator
• Unless you and we agree otherwise, arbitration will take place in the county where you live, or by telephone or video conference, or through documents only where the AAA rules allow
• The arbitrator may award the same individual relief a court could, including statutory damages and attorneys' fees where a statute provides them
• The arbitrator's decision is final and binding, and judgment on it may be entered in any court with jurisdiction
• Fees follow the AAA Consumer Arbitration Rules. Your filing fee will not exceed the lower of the AAA consumer fee cap or the fee to file in court. We pay the remaining filing, administration, and arbitrator fees. Fees may be reallocated only as permitted by the AAA rules and applicable law

What is not covered

• Either party may bring an individual claim in small claims court if it qualifies
• Either party may seek injunctive or equitable relief in court to protect intellectual property rights or to stop unauthorized access to the Service
• Nothing in this section prevents you from reporting conduct to, or seeking relief from, a government agency, including a state attorney general or the Federal Trade Commission
• Claims of sexual assault or sexual harassment are excluded from mandatory arbitration to the extent required by the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, and you may bring such a claim in court

Class action and jury trial waiver

You and Tachara LLC agree that any dispute resolution proceeding will be conducted only on an individual basis, and not as a class, consolidated, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding. You and Company also waive any right to a jury trial for disputes that proceed in court.

If a court decides that the class action waiver is unenforceable as to a particular claim, or as to a request for public injunctive relief, then that specific claim or request will be severed from arbitration and heard in court, and every other claim will still be arbitrated.

Your right to opt out of arbitration

You may opt out of this arbitration agreement. Email info@tolu.dating with the subject "ARBITRATION OPT-OUT" within 30 days of first accepting these Terms, and include your name and the email address on your account. Opting out has no effect on your account, your subscription, or any other part of these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Texas, and you and Company consent to personal jurisdiction and venue there, subject to the exceptions in the next paragraph.

Venue for claims not subject to arbitration

Any dispute that is not subject to arbitration will be brought exclusively in the state or federal courts located in the State of Texas, and you and Company consent to the personal jurisdiction of those courts, unless mandatory law gives you the right to another venue. This provision does not restrict either party's right to use a small claims court with jurisdiction.

Survival and severability

This Dispute Resolution section survives termination of your account and of this Agreement. If any part of it other than the class action waiver is found unenforceable, that part is severed and the rest remains in effect. If the class action waiver itself is found unenforceable as to all claims, then this entire arbitration agreement is void and disputes will be resolved in the Texas courts identified above.

📄 General Provisions

• Entire agreement: These Terms, together with the Privacy Policy and the Child Safety Policy, are the entire agreement between you and Company regarding the Service and supersede any prior agreement on the subject
• Severability: If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest of these Terms will remain in full force
• No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later
• Assignment: You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets
• Notices: We may give you notice by email to the address on your account, by in-app message, or by posting on the Service. Notices to us go to info@tolu.dating
• Force majeure: Neither party is liable for a failure to perform caused by an event beyond its reasonable control, including outages at our hosting or storage providers, network failures, natural disasters, and government action
• Third party services: The Service relies on third parties such as Apple, Google, and our hosting, storage, calling, and moderation providers. We are not responsible for their acts or omissions, and their own terms may apply to you
• Feedback: If you send us suggestions or feedback, you grant us an unrestricted right to use them without obligation or compensation to you
• No agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Company
• Language: This page is provided in English and Farsi. If there is any conflict between the two versions, the English version governs, except where the law of your country requires otherwise
